We should be doing our utmost to not only substantially increase our judicial salaries as the enlightened William Cumming suggests, but we here on Main Street would look forward to these men and women sharing their views, their perspectives on "The Prognosis of 21st Century Law and The Constitution in America" with hopes that CNN or Fox News or C-Span will enjoin those recognized by peers as objective and caring so as to see and hear these folks convey more clarity as to our laws as its relates to the Constitution and Bill of Right for we are frightened these days of so much talk of compromise of our Constitution as well as State Constitution and basic rights....as it seems Congress is far too involved in assuring the Rights of outright Muslim murders of innocents than the ordinary citizen....

In the meantime since my earlier comment I realized I overlooked an important premise of Bobbit's article! Submission of proposed legislation by the Executive or even introduction of self-initiated legislation by Congress has been remarkably limited or even absent since 9/11/2001. Both for Bush Administration and Obama Adminstration this failure could be discribed as innate caution or whatever! In fact I believe it is incompetence and the failure of the Department of Justice to have the horses it once had to do what needs doing. Most of the real pros departed from DOJ long ago and have never been replaced. Documentation of politicization deep into the trial divisions and policy divisions like OLC has long existed. Hey DOJ salaries are just not competitive even with law professor salaries or starting associates in major firms. Time for special rules for those identified in 1941 by the mini-HOOVER Commission as carrying the heavy pails of water for UNCLE SAM. And the DOJ travel schedules are unbelieveable and destructive of normal family life.

So here is my new suggestion, just as I previously suggested no STATE DEPT. budget but just make it 10% of whatever DOD budget is adopted and give the Secretary of STATE complete discretion as to its utilization, now lets add the AG and give him or her 10% of the DOD budget. Hey let's restore civil government and take it away from the militarists and contractors that are destroying what is left of the country by the residue of the 40% of national income left from the Wall Streeters and FIRE sector. Do we really need all those tax evasion havens in the HAMPTONs where the rich fail to pay taxes owed on their rental incomes. Time for the US to grow up. And while we are at it let's double all judicial salaries and keep some of the best and brightest.

I think in general Bobbit nails "it" with "it" being the intersection of the rule of law and warfare against non-state actors.

What I find most interesting as we head towards the year 9 anniversary of 9/11 my somewhat biased analysis is we (US) ain't got a clue as to how the American legal and justice system has taken steps or will finalize its positions on many of the legal issues arising out of 9/11. What is of most interest to me with the potential departure in June of two more Associate Justices of SCOTUS is that the most recent nominee was asked virtually no questions about her understanding of National Security Law and policy. Well maybe it will take another full decade to find out where we (US) really stands on being a nation under "law"! Thanks for posting.
