SCOTUS rules in favor of ACA but not having read the full opinion don’t know what problems it creates or solves until I do so read it!

And those who may wonder why this why now my memory of the paper refreshed by a post and thread on Sic Semper Tyrannis blog recently.

When the paper appeared I had copies distributed to the few thinkers in FEMA where I was then working. Terrorism was in fact part of the FEMA portfolio from the beginning but always somewhat below the horizon.

Terrorism IMO has fully metastisized [sic] now. So it will be curious to see how the USA adapts to this feature of a Globalized world.

Today it is Islam but tomorrow perhaps another religion or set of political beliefs. Both Capitalism and Communism are political belief systems and may well have all the trappings of religions.

And if you adopt my view of terrorism–organized violence against innocents–then both Communism, Capitalism, and various religions must be held to account.

So the resting of my comments will be devoted to what I hope is a dose of reality and worthy of consensus, and perhaps will help shape a Presidential Campaign next year where reality has yet to show its face.

My thesis is that the American polity lacks the information it needs to maintain democracy or remain free.

Whether or not classified it is difficult for even interested persons to obtain information about federal programs, functions, and activities many if not all that impact or affect them in one way or another.

I also distinguish between PATRIOTISM and NATIONALISM!

NATIONALISM run a muck was the bane of the 20th Century and the question is will it continue to do so?

There is no question IMO that the NATION-STATE system largely created by the Westpahlian Treaties of the 1600’s and established as a REFORM to help quell the violence of the WARS OF RELIGION sparked by the REFORMATION is now perhaps dying and even subject to self-destruction by the existing NATION-STATES THEMSELVES.

So what has the above theme have to do with HS and EM?

IMO it has much to do with HS and EM. Why?

A first principle is that all NATION-STATES are primarily concerned with GOVERNANCE or should be! Hopefully GOOD GOVERNANCE!

For HS that means CIVIL SECURITY! For EM that means the organization and implementation of the full spectrum of EMERGENCY MANAGEMENT when the need arises.

Neither CIVIL SECURITY NOR EMERGENCY MANAGEMENT will ever reach perfection IMO. One of the main reasons is the periodic turnover of those having survived large scale catastrophe and worked in that context.

And of course is there some reasonable expectation by the citizens and residents of the USA for CIVIL SECURITY and EMERGENCY MANAGEMENT. Hopefully of course like the guidance of the Hippocratic Oath HS and EM will not make matters worse.

Yet based on recent events domestically and even world-wide the leadership of both HS and EM may have made bad results more likely then not. Why?

First, PREPAREDNESS remains a stepchild. MONEY applied after the fact [catastrophe] may be rewarding bad habits. Or bad GOVERNANCE.

Neither Governor Cuomo nor Christie has yet announced formally for President although IMO both want that job. Not sure why but they do IMO.

But STORM SANDY largely rewarded decades of bad GOVERNANCE IN NEW YORK AND NEW JERSEY.

So following close what each of them did with the injection of $60B in federal funds is worthy of close study.

And both parties have wrapped themselves around the IMMIGRATION axle IMO!

ODDLY PRESIDENT GEORGE W. BUSH AND SECRETARY DHS MICHAEL CHERTOFF came up with IMO reasonable IMMIGRATION reform legislation only to see it die in the U.S. Senate killed by Republicans.

BUT the complex issues of IMMIGRATION, containing both CIVIL LAW and CRIMINAL LAW provisions will and has determined what kind of a nation-state we have or whther it will persist. Thus, IMMIGRATION is not just an expectation of GOVERNANCE like

HS and EM but in fact a bounding of what are nation-state is and will be.

Thus, a basic responsibility of all candidates, the MSM, and polity generally is to force all Presidential candidates to speak to the issues and policies and their views on IMMIGRATION.

AND I AGAIN EMPHASIZE THAT A NATION-STATE THAT CANNOT CONTROL ITS OWN BORDERS [BY FORCE IF NECESSARY] DOES NOT REALLY QUALIFY AS A NATION-STATE.

From time to time I will be injecting my views of FEDERALISM on my comments on this blog. FEDERALISM is grounded in the CONSTITUTION and has many elements. I have also opined that just as their is a PERMANENT STANDING JOINT COMMITTEE OF THE CONGRESS on the BUDGET, there should also be one on FEDERALISM issuing reports on each new bill and piece of legislation giving a full analysis of the COMMITTEE’S opinion as to the implications for our federal system on the bill!

Even better would be a system in which each House of Congress identifies what it believes is Constitutional authority for any legislation.

IMO all the costs of IMMIGRATION policy, enforcement, and administration should be borne by the FEDERAL GOVERNMENT.

The STATES and their Local Governments should not be involved including deportation questions and enforcement.

With the ACA upheld for statutory construction reasons by SCOTUS perhaps it is again time to focus on the lack of public health preparedness generally in the USA!

IMO public health preparedness has undergone at least a 50% reduction in public funding since 2008!
